Scenario
Criminal Defense case where the client attorney has three cellphones, related to a homicide. The client needed to understand the relationships between the owners of the cellphones.
The Challenge
The client attorney wanted a better understanding of why the shooting took place. The three cellphones were collected by law enforcement, but no analysis was completed by law enforcement on the communication between the parties involved.
The Solution
The client attorney hired Vestige to perform digital forensics and analysis of the cellphones involved in the case.
- Through the analysis, Vestige was able to determine that the Victim and one of the female subjects in the case had been involved in a sexual relationship.
- Vestige was also able to pull out all of the text communication, pictures and videos between the parties.
- Digital evidence showed the Victim in this case tried to communicate with female subject with different social media applications, after being blocked.
- The location data within the Victims cellphone also revealed stalking-like behavior.
- A video on the Victim’s phone showed a successful kidnapping attempt of the female subject.
- The Victim’s cellphone showed that he would repeatedly show up at the female subject’s house after she got off work. This was the same activity on the night the Victim was shot.
- A video map of the Victim’s movements the night of the shooting was created and turned over to the prosecution based on cell phone location data.
The Result
All of the additional videos, communication and location data of the Victim, was turned over to the prosecution. After showing the malicious actions of the Victim, based on his cellphone evidence, the prosecution dropped the charges of the shooter from Capital Murder and reduced it to Manslaughter.
